UP Board Of Madarsa Education Act 2004 As Unconstitutional And Against Secularism: Allahabad High Court
Lucknow, March 22 (TNA) In a major decision, Lucknow bench of the Allahabad High Court (HC) on Friday declared the UP Board of Madarsa Education Act 2004 unconstitutional and against secularism. The court also directed the UP government to accommodate the students studying in madrasas in the basic education system.
The UP government has constituted SIT in October 2023 to investigate madrasas. SIT is investigating the foreign funding being given to madrasas. Petitioner Anshuman Singh Rathod and others had challenged the Act by filing a petition. Amicus Curiae Akbar Ahmed and other advocates presented their case in the court. After the hearing, the division bench of Justice Vivek Chaudhary and Justice Subhash Vidyarthi gave this order.
Anshuman Singh Rathore and others had filed a petition challenging the powers of the Madrasa Board. In the petition, objections were raised to the management of madrassas by the Government of India, the State Government and the Minority Welfare Department. On the decision, Registrar of UP Madarsa Board Priyanka Awasthi said that the full order is still awaited. The situation will become clear only after the order and the decision will be taken accordingly.
