Allahabad HC Refuses To Transfer Criminal Trial Proceedings In Hathras Gang Rape
Prayagraj, August 28 (TNA) The Allahabad High Court has refused to stay or transfer the criminal trial proceedings in the Hathras Gang Rape case which are pending before the Special Court (SC/ST Act), Hathras.
A bench of Justice Jaspreet Singh and Justice Rajan Roy further has said that the requisite security which was ordered by the Court to ensure non-disruption of the trial by any person and for facilitating a free and fair trial, will remain in place.
The HC, had on March 19 directed an inquiry into the allegations after taking into account the complaint made by the Victim's family in Hathras Rape and Murder case regarding the threats extended to them, including the Counsel for the Victim's family in the open Court.
Allegedly, shortly after the prosecution witness began deposing before the Presiding Officer, Special Court (SC/ST Act), Hathras on March 5 this year, an advocate had barged into the courtroom and lunged towards the applicant and the complainant counsel, shouting and issuing threats.
Allegedly, at the same time, a large mob, including lawyers, entered the courtroom and surrounded the applicant and the complainant's counsel in order to threaten and intimidate them.
