Allahabad High Court Quashes All Criminal Proceedings Against Dr Kafeel Khan In AMU Alleged Hate Speech Case

Prayagraj, August 26 (TNA) In a big win for the beleaguered suspended paediatrician of BRD medical college, Gorakhpur, Dr Kafeel Khan, the Allahabad High Court (HC) on Thursday quashed all criminal proceedings against him with regards to the hate speech allegations levelled against him by the state government.

The government had booked Khan under the National Security Act (NSA) against a speech which he allegedly gave at the Aligarh Muslim University (AMU) against the CAA and NRC.

The Allahabad High Court (HC) had on August 18 reserved its judgement on a case of hate speech. The matter was being heard by the single bench of Justice Gautam Chowdhary.

He was booked for inciting hatred against communities and was charged under the National Security Act (NSA). The HC had last year only quashed the NSA proceedings on him.

In this petition, the counsel of Kafeel Khan had demanded that the FIR should also be quashed now and has brought to the notice of the court that no permission was taken during filing of the chargesheet. He also had said that it is mandatory to do so when a chargesheet was being filed against a class I officer of the government.

Dr Kafeel, through his lawyer, had also pleaded that he did not give any speech of the kind he is charged with and that it was a normal speech.
