Criminal Revision Petition Of Former UP Minister Azam Khan Not Heard By Allahabad HC Today, April 4 Next Date
Prayagraj, March 12 (TNA) The criminal revision petition of former UP minister and senior Samajwadi Party (SP) leader Mohd Azam Khan, his wife and former MP Dr Tanzeen Fatima and son Abdullah Azam Khan could not be heard on Tuesday. In court today, Dr Tanzeem Fatima's lawyer demanded an early hearing from the court based on her age.
The court fixed April 4 for a hearing in the case. Complainant Akash Saxena's advocate Sharad Sharma gave information on the case. BJP MLA Akash Saxena had filed a case against former MLA Abdullah Azam, son of SP National General Secretary Azam Khan, at Ganj police station in Rampur in 2019 for having two birth certificates.
A case was registered under sections 193, 420, 467, 468, and 471 of IPC in Ganj police station of Rampur. Azam Khan and his wife Dr Tanzin Fatma were also named accused in this. Rampur MP/MLA court has sentenced all three to seven years imprisonment in the case of making two birth certificates of Abdullah Azam.
In the case of making two birth certificates of the younger son Abdullah Azam, the MP-MLA court has sentenced Azam Khan, Abdullah Azam and Dr. Tanzin Fatma to seven years imprisonment each. All three have challenged the decision of Rampur Sessions Court rejecting their bail plea in Allahabad High Court and have filed a criminal revision petition to grant bail and cancel the sentence.
All three were sentenced by Rampur MP/MLA court in October 2023. Last year also, Allahabad High Court had rejected Azam Khan's petition to stay the ongoing trial in Rampur MP-MLA court. Azam Khan's son Abdullah Azam won from Swar seat in Rampur district in the 2017 Uttar Pradesh Assembly elections. Abdullah had defeated Bahujan Samaj Party candidate Nawab Kazim Ali Khan in this election.
After the election results, BSP candidate Nawab Kazim filed a petition in Allahabad High Court regarding two different dates of birth in Abdullah's school and birth certificate, demanding the cancellation of his membership.
Allahabad High Court, while giving its verdict in this case, had ordered to cancel the membership of Abdullah. Abdullah had also challenged the same order of the High Court in the Supreme Court, however, he did not get any relief from the Supreme Court in this matter.
All three have filed a criminal revision petition in Allahabad High Court against the decision of the Sessions Court. A single bench of Justice Sanjay Kumar Singh is hearing the case.
