Krishna Janmabhoomi-Shahi Eidgah Case: Hearing On Objection On Maintainability Of Civil Suit To Continue Today
Prayagraj, February 23 (TNA) The hearing of the civil case pending in the Allahabad High Court which was held on Thursday regarding the demand to remove the illegal possession of the Shahi Idgah Mosque from the land registered in the name of Keshav Dev and handing over the enshrined Lord Shri Krishna to other demands will continue at 2 pm on Friday too.
The bench of Justice Mayank Jain is hearing 18 civil cases including those of Lord Shri Krishna, Virajman Katra Keshav Dev and others. Senior Supreme Court advocate Tasneem Ahmadi argued through video conferencing on the objection raised by the mosque side on the maintainability of the civil suit under Order 7 Rule 11 of the Code of Civil Procedure.
He said, under the Places of Worship Act 1991, the nature of any religious place cannot be changed on August 15, 1947. The court has no right to hear any case regarding this. Therefore the civil suit should be cancelled. He cited an agreement made between the two sides before independence and said that the civil suit should be dismissed on this basis also. The matter decided by the court cannot be raised in the court again.
The Muslim side also told the court that the Shahi Idgah Mosque is Waqf property. The civil court has no authority to hear the dispute regarding this. After a long debate of about three hours, the hearing was adjourned due to lack of time.
No one presented its side from the Sunni Central Waqf Board. Advocates Nasiruzzama, Hare Ram Tripathi, Pranay Ojha, senior advocates Wajahat Hussain Khan, and MK Singh presented their views on behalf of other opposition parties.
During the hearing, apart from amicus curiae, senior advocate Manish Goyal and Akanksha Sharma, all the advocates and parties of the plaintiff side were present. Advocates Prabhash Pandey, Pradeep Sharma, Saurabh Tiwari, and Mahendra Pratap Singh were in the court on behalf of the Hindu side.
