Not Against Live-in But Illicit Relationship Not A Basis Of Providing Security: Allahabad HC

Prayagraj, July 5 (TNA) The Allahabad High Court has said that if was against illegal relationship and henceforth denied protection to woman in a live-in. Justice Renu Agarwal has given this order on the petition of Prayagraj resident married woman and others. It was argued on behalf of the petitioner that she is an adult woman of 37 years. Since January 6, 2015, she is voluntarily and peacefully living in live-in with the second petitioner due to the tortuous behavior of her husband. She alleged that the husband was trying to endanger her peaceful life.

Allahabad High Court has said that it was are not against live-in-relationship, but against illegal relationship. Illicit relations cannot be given police protection at the cost of social fabric. Giving protection to those in illegal relationships means recognizing illegal live-in relationships, it noted.

With this important remark, the court has dismissed the petition filed by a married woman (petitioner) living in a live-in relationship with a man seeking security in view of apprehension of security threat from her husband.

There is no criminal case against both of them, nor is there any case registered in this matter. It was said on behalf of the government that the petitioner was living in an illegal live-in with a man, he's married while divorce is not done and her husband is alive. The court has earlier also refused to grant security in such a case.

Divorce is already included in the sanctity of marriage.' If the petitioner has any difference of opinion with her husband, she has to first proceed for separation from him in accordance with the law in force. The wife cannot be allowed to live in an illegal relationship with another man while the husband is alive.
