Setback For Azam Khan As Allahabad HC Dismisses Plea Against ADM Order To Return Land Of Jauhar University
Prayagraj, Sep 6 (TNA) The Allahabad High Court has upheld the order of ADM Finance to vest the additional 12.50 acres of land acquired by former cabinet minister Mohammad Azam Khan's Maulana Mohammad Ali Jauhar Trust Rampur in the state.
About 471 acres of land was acquired for the construction of the university. Only 12.50 acres of land will remain in the possession of the Trust. The court has dismissed the trust's petition challenging the SDM's report and the validity of the ADM's order.
The court said that the scheduled caste land was taken illegally without the permission of the District Magistrate. In violation of the acquisition conditions, instead of construction for educational work, a mosque was built.
The Chak Road land for public use of the Gram Sabha and government land on the banks of the river were also taken. The farmers were forcibly made to sign the bond, in which 26 farmers have lodged an FIR against Azam Khan, the former minister and chairman of the Trust.
The court said that the university was to be built in five years, the annual report of which was not given. Cannot interfere with the order to vest the land in the State on the ground of contravention of the legal provisions and conditions.
This order has been given by Justice Rohit Ranjan Agarwal on a petition filed by Maulana Mohammad Ali Jauhar Trust.
